Legislative Framework
The Legislative Framework incorporates the:
- Education Services for Overseas Students (ESOS) Act 2000
- National Code of Practice for Providers of Education and Training to Overseas Students (National Code) 2018
The ESOS Framework has been meticulously crafted to institute and uphold national standards governing the delivery of education and training services for international students. The legislative framework is designed with the overarching goal of safeguarding the interests of international students and ensuring the delivery of high-quality education. Additionally, it empowers the Department of Education to take decisive action against providers found to be in violation of their obligations.
It is imperative to note that the Legislative Framework exclusively pertains to students enrolled in onshore programs who continue to reside in Australia on a Student Visa. This legislation, however, does not extend its jurisdiction to students engaged in offshore programs or those remaining in Australia under a temporary visa other than a Student Visa.
